1. Introduction
These Terms of Use (the "Terms") set out the terms and conditions under which Matthieu Lerat (the "Publisher") makes the Arom mobile application (the "App" or the "Service") available, as well as the rights and obligations of users (the "User" or "you").
Using the App implies full and unconditional acceptance of these Terms. If you do not accept all or part of these Terms, you must not use the App.

3. Definitions
- Application / Service: the Arom mobile application, published by the Publisher, including all of its features (food-and-drink pairing suggestions, personal cellar management, wine label recognition, recipe suggestions, etc.).
- Account: the personal space created by the User to access the Service.
- User: any individual who downloads, installs and/or uses the Application.
- AI Suggestions: recommendations automatically generated by artificial intelligence mechanisms (food/wine pairings, label recognition, recipe suggestions).
4. Description of the Service
Arom is an application that helps users to:
- get suggestions for drinks (wine, beer, non-alcoholic beverage) suited to a given dish, or conversely suggestions for dishes suited to a given wine;
- build and manage a virtual "personal cellar" (adding wines, batch import, manual entry, or label recognition);
- view recipe sheets associated with dish suggestions.
These features rely wholly or partly on automated processing / artificial intelligence. The Publisher reserves the right to develop, add, modify, or remove features at any time, without notice, in particular for technical, legal, or business reasons.
5. Access to the Service and Account Creation
Access to the App's features requires creating a user account (for example via email/password or via a third-party identity provider, depending on the options offered in the App).
The User undertakes to:
- provide accurate information when creating their account;
- keep their login credentials confidential;
- promptly inform the Publisher of any unauthorized use of their account.
The User is solely responsible for any activity carried out from their account, except in the case of proven fraudulent use not attributable to their negligence.
6. Minimum Age and Responsible Consumption
The App refers to alcoholic beverages as part of its food-and-wine pairing suggestions.
Use of the App is restricted to individuals aged 18 or over. By creating an account, the User represents and warrants that they are at least 18 years old.
Alcohol abuse is dangerous for your health, please drink responsibly. Arom does not sell alcohol and only provides suggestions for informational purposes; the User remains solely responsible for their alcohol consumption and for complying with the regulations applicable in their country of residence.
7. AI-Generated Suggestions — Disclaimer
The suggestions offered by the App (food-and-drink pairings, label recognition, recipes) are generated automatically and provided for purely informational and indicative purposes.
The Publisher does not guarantee the accuracy, completeness, or relevance of these suggestions. They do not constitute professional advice (oenological, culinary, medical, or nutritional) and the User remains solely responsible for judging and acting on the choices they make based on them (purchase, consumption, allergies, specific dietary requirements, etc.).
8. User Obligations
The User undertakes to use the App in accordance with its intended purpose and applicable regulations, and in particular not to:
- use the App for fraudulent or unlawful purposes;
- attempt to compromise the technical operation of the App (reverse engineering, automated data extraction, etc.);
- impersonate a third party.
9. Intellectual Property
The App, its name, logo, design, texts, and all elements comprising it are protected by intellectual property law and remain the exclusive property of the Publisher.
Nothing in these Terms shall be construed as granting the User any license or exploitation right over these elements, other than the right to strictly personal use of the App in accordance with its intended purpose.
Some illustrative dish photographs displayed in the App are provided by third-party photographers via the Unsplash API and remain the property of their respective authors. The photographer's name and a link to their profile are shown alongside these photographs within the App.
10. Personal Data
The processing of Users' personal data (including account data, personal cellar data, and usage data) is covered by a separate document: the Privacy Policy.
In the event of a conflict between these Terms and the Privacy Policy on this specific point, the Privacy Policy shall prevail.
11. Availability and Evolution of the Service
The App is currently offered free of charge. The Publisher reserves the right to introduce paid features or a subscription model in the future, subject to clear prior notice to Users and, where applicable, the adoption of specific Terms of Sale.
The Publisher strives to ensure the availability of the Service but does not guarantee continuous, uninterrupted, or error-free access. Interruptions may occur, in particular for maintenance operations or for reasons beyond the Publisher's control (hosting provider outage, App Store outage, etc.).
12. Limitation of Liability
To the extent permitted by applicable law, the Publisher shall not be held liable for:
- direct or indirect damages resulting from the use or inability to use the App;
- the consequences of decisions made by the User based on AI Suggestions;
- damages resulting from improper use of the App by the User.
13. Suspension and Termination
The User may stop using the App and request deletion of their account at any time, in particular via the features provided for this purpose in the App or by contacting the Publisher.
The Publisher reserves the right to suspend or delete, without prior notice, a User's account in the event of a breach of these Terms, in particular in the event of fraudulent, abusive, or unlawful use of the Service.
14. Changes to These Terms
The Publisher reserves the right to modify these Terms at any time, in particular to adapt them to changes in the Service or in applicable regulations. The version in force at the time of use of the App shall apply. In the event of a material change, Users will be informed by appropriate means (in-app notification, for example).
15. Governing Law and Disputes
These Terms are governed by French law, including for Users located outside France, without prejudice to any mandatory consumer protection provisions that may apply in the User's country of residence.
In the event of a dispute, the User is invited to first contact the Publisher to seek an amicable resolution, using the contact details provided in Section 2.
